Terms of service

1. Welcome to Victo

These terms are an agreement between you and Victo. They explain the rules for using our app and website. We've written them to be clear and free of unnecessary legal jargon.

Victo is a running and fitness app that helps you record your runs, follow structured workouts, and train with intent. It's operated by Victo B.V., a company registered in the Netherlands.

In these terms, “Victo,” “we,” “us,” and “our” mean Victo B.V. “You” means you, the person using Victo. When we talk about “the Services,” we mean the Victo app, the victo.run website, and the features we provide through them.

2. Accepting these terms

By creating an account or using the Services, you agree to these terms. If you don't agree with them, you won't be able to use Victo.

These terms work alongside our Privacy Policy, which explains how we handle your personal data.

3. Who can use Victo

To use Victo, you need to be at least 16 years old. By using the Services, you confirm that you are. Victo isn't intended for children, and we don't knowingly allow anyone under 16 to create an account.

4. What Victo does

Victo helps you plan, record, and understand your running and training. Depending on the features you use, Victo lets you:

• Record your runs and workouts, including route, pace, distance, and heart rate
• Create and follow structured workouts and training plans
• Sync your activities to Apple Health
• Connect other services and devices, such as Strava, Garmin, Coros, and Suunto, so your activities can be sent to them
• Review your activity history and progress over time

We're always working to improve Victo, so features may be added, changed, or removed over time. Some features are free, and others are part of a paid subscription. We'll explain how that works next.

5. Your account

To use most of Victo's features, you'll need an account. You can create one using the sign-up methods we offer.

You're responsible for your account and for keeping your login details secure. Please don't share your account with anyone else, and let us know at support@victo.run if you think someone has accessed it without your permission.

6. Subscriptions and payments

Victo is free to use for its core features. Some features, such as creating custom workouts and training plans, are part of a paid subscription.

How billing works

Subscriptions are sold and processed through the app store you downloaded Victo from, such as Apple's App Store. When you subscribe, your payment is handled by the app store under its own terms, not directly by us. We don't receive or store your payment details.

Renewals

Subscriptions automatically renew at the end of each billing period unless you cancel beforehand. You can manage or cancel your subscription in your app store account settings, and cancellation takes effect at the end of the current period.

Refunds

Because payments are handled by the app store, refunds are subject to that store's refund policy, and any refund requests are handled by the store. If you're a consumer in the EU, you keep the statutory rights you have under EU consumer law, including any applicable right of withdrawal.

Price changes

We may change subscription prices from time to time. If we do, we'll give you notice in advance, and any change will only apply to future billing periods, never retroactively.

7. Connecting other services

Victo lets you connect other services and devices, such as Apple Health, Strava, Garmin, Coros, and Suunto, so your activities can be sent to them. Connecting any of these is your choice, and you can disconnect at any time.

When you connect one of these services, you're also agreeing to that service's own terms and privacy policy. We're not responsible for how those services handle your data once it reaches them, or for what they do with it. If something goes wrong on their side, you'll need to take it up with them directly.

8. Acceptable use

We want Victo to work well for everyone, so there are a few things we ask you not to do. When using Victo, you agree not to:

• Break the law, or use Victo for anything illegal
• Copy, modify, reverse-engineer, or try to extract the source code of our app, except where the law specifically allows it
• Interfere with or disrupt the Services, or try to get around our security or technical limits
• Access the Services using automated means, such as bots or scrapers, without our permission
• Misuse another person's account, or try to access data that isn't yours
• Use Victo in a way that could harm, disable, or overburden it

If you break these rules, we may suspend or close your account. See “Ending your use of Victo” below.

9. Your content and sharing

Anything you record or create in Victo, such as your runs, routes, workouts, and training data, belongs to you. We don't claim ownership of it. We just need your permission to store and process it so we can provide the Services, which you give us by using Victo, and which we explain in our Privacy Policy.

Victo is designed for your own personal use. Your data stays private to you unless you choose to share it. If you use a share feature to post an activity to social media or another app, you're the one publishing it, and from that point it's covered by the terms and privacy policy of the platform you shared it to.

10. Health and fitness disclaimer

Victo is a fitness tool, not a medical service. The workouts, training plans, and data Victo provides are for general fitness and informational purposes, and they aren't medical advice.

Exercise carries some risk, and only you know your own body. Before starting a new training plan or workout, especially if you have a health condition, an injury, or any concerns, please check with a doctor or qualified health professional. If you feel unwell or in pain while exercising, stop and seek help.

You're responsible for exercising safely and within your limits. To the extent the law allows, you take part in workouts and activities through Victo at your own risk.

The data Victo shows you, such as pace, distance, heart rate, and calories, is an estimate. It can be affected by your device, sensors, and conditions, so it may not always be perfectly accurate, and you shouldn't rely on it for medical purposes.

11. Our intellectual property

Victo, including the app, the Victo name and logo, our designs, and the content we create, belongs to us or our licensors, and is protected by intellectual property laws. These terms don't give you any ownership of Victo itself.

You're welcome to use Victo for your own personal, non-commercial use, as these terms allow. Please don't use our name, logo, or branding without our permission.

12. Availability and changes to the Services

We work hard to keep Victo running smoothly, but we can't promise it will always be available or completely free of interruptions. From time to time we may need to perform maintenance, fix problems, or update the app, and parts of the Services may be temporarily unavailable.

Victo is also actively evolving. We may add, change, or remove features as the app develops. If we ever make a change that significantly reduces the core features you're paying for, we'll aim to give you reasonable notice.

13. Disclaimers and limitation of liability

Victo is provided on an “as is” and “as available” basis. While we work hard to make it reliable and useful, we can't guarantee that it will always be accurate, uninterrupted, or error-free.

To the fullest extent permitted by law, we limit our liability to you as follows:

• We're not liable for indirect or unforeseeable loss, or for things outside our reasonable control.
• We're not responsible for the accuracy of fitness data such as pace, distance, heart rate, or calories, which are estimates, or for third-party services you choose to connect.
• Where we are liable, our total liability to you is limited to the amount you paid us for the Services in the 12 months before the issue arose.

What we don't limit

Nothing in these terms excludes or limits our liability where the law doesn't allow it. This includes liability for death or personal injury caused by our negligence, for fraud, or for anything else that can't be limited under Dutch or EU law. If you're a consumer, you also keep all the rights and protections that consumer law gives you, and nothing here takes those away.

14. Ending your use of Victo

You're free to stop using Victo at any time. You can delete your account directly in the app, which removes your personal data as described in our Privacy Policy. If you have a paid subscription, remember to cancel it through your app store. Deleting the app alone doesn't cancel a subscription.

We may suspend or close your account if you break these terms, misuse the Services, or where we're required to by law. If we do, we'll aim to let you know, unless we're prevented from doing so. If your account is closed, the parts of these terms that should reasonably continue, such as those on intellectual property and liability, will still apply.

15. Changes to these terms

We may update these terms from time to time, for example as Victo grows or as legal requirements change. If we make significant changes, we'll let you know through the app or by email before they take effect. If you keep using Victo after the changes take effect, that means you accept the updated terms. If you don't agree with them, you can stop using Victo and delete your account.

16. Governing law and disputes

These terms are governed by the laws of the Netherlands. If there's a dispute we can't resolve informally, it can be brought before the competent courts of the Netherlands.

If you're a consumer, this doesn't take away the protection of any mandatory laws of the country you live in, and you may also be entitled to bring proceedings in your local courts. Wherever you are, we'd always encourage you to contact us first at support@victo.run. Most issues are much easier to sort out directly.
